Terms of Service

1. Service Description
APIbase.pro ("Service") is an MCP (Model Context Protocol) gateway that provides AI agents with programmatic access to 502+ API tools from 158+ providers through a single endpoint. The Service includes domain registration, DNS management, data retrieval, content generation, and other tools. Payments are processed via x402 USDC micropayments on Base.
2. Acceptance
By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. Agent Accounts
- Agents receive API keys automatically upon first request (auto-registration).
- Each agent is identified by a unique agent_id and API key hash.
- You are responsible for safeguarding your API key. Do not share it.
- All activity under your API key is your responsibility.
4. Payment Terms
- Tool calls are billed per-call via x402 USDC micropayments on Base.
- Prices are listed in the tool catalog.
- Escrow model: USDC is locked before the provider call. On failure, USDC is auto-refunded.
- Domain registration fees include the upstream registrar cost plus a service markup.
- All payments are final. Refunds are automatic on provider failure only.
5. Prohibited Uses
The following activities are strictly prohibited. Violations result in immediate account suspension and may be reported to law enforcement.
- Child sexual abuse material (CSAM) — zero tolerance. Any content exploiting, depicting, or sexualizing minors. Reported to NCMEC and law enforcement immediately.
- Illegal drugs and controlled substances — sale, distribution, or promotion of narcotics, steroids, drug paraphernalia, or products designed to pass drug tests.
- Weapons and explosives — sale or promotion of firearms, ammunition, explosives, or instructions to manufacture weapons.
- Human trafficking and organ trade — any content related to trafficking, exploitation, or illegal trade of human beings or organs.
- Terrorism and violent extremism — recruitment, glorification, planning, or promotion of terrorist acts or extremist ideologies.
- Fraud and phishing — impersonation, identity theft, credential harvesting, or financial fraud schemes.
- Malware and hacking — distribution of viruses, ransomware, spyware, or tools for unauthorized access to systems.
- Harassment and hate speech — content promoting hatred or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
- Self-harm and suicide — content promoting, encouraging, or providing instructions for self-harm or suicide.
- Counterfeit goods — sale or promotion of fake branded products or forged documents (IDs, passports, diplomas).
- Spam and abuse — mass automated requests intended to degrade service, DDoS, scraping beyond fair use, or abusing tool calls for non-intended purposes.
- Domains for illegal purposes — domains registered through our Service must not be used for any of the prohibited activities listed above.
6. Domain Registration
- Domains are registered through third-party registrars (currently NameSilo) on behalf of the agent.
- The agent is the beneficial owner and is solely responsible for content hosted on registered domains.
- APIbase is a reseller/intermediary, not the domain host or content provider.
- We reserve the right to cooperate with ICANN, law enforcement, and registrar abuse teams regarding domain complaints.
- Domains used for prohibited activities may be reported to the registrar for suspension.
7. Audit Trail and Compliance
- Every tool call is logged with: agent_id, tool_id, timestamp, billing status, and execution result.
- Domain registrations are logged with the purchasing agent_id and transaction details.
- Financial records are stored in an append-only ledger (never modified or deleted).
- We comply with lawful data requests from law enforcement authorities.
- Nginx access logs (including IP addresses) are retained for 15 days.
8. Account Suspension
- We may suspend or terminate your access immediately for violations of these Terms.
- Repeated policy violations, excessive API abuse, or fraud result in permanent ban.
- Suspended agents lose access to all tools. Domain ownership is not affected by account suspension.
- We are not obligated to provide notice before suspension for prohibited content violations.
9. Limitation of Liability
- The Service is provided "as is" without warranties of any kind.
- APIbase is not liable for upstream provider outages, data accuracy, or third-party service failures.
- APIbase is not liable for content hosted on domains registered through the Service.
- Maximum liability is limited to the amount paid by the agent in the preceding 30 days.
10. Intellectual Property
Data returned by API tools belongs to the respective upstream providers and is subject to their terms. APIbase claims no ownership over data passing through the platform.
11. Changes
We may update these Terms. Changes are effective immediately upon posting. Continued use constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which the Service operator resides. Disputes shall be resolved through good-faith negotiation first.
